Constitution of India, 1950, Article 136 – Indian Penal Code, 1860, Section 302, 307, 148 and 149 – Murder – Conviction – Murder of Brothers of Complaint committed by group of villagers – Ocular evidence of two eye witnesses fully corroborated by medical evidence proving accused persons used blunt and sharp weapons to cause injuries on deceased persons and complainant as well as depositions of eyewitnesses in consonance with contents of FIR – In light of facts of case although complaints was brother of deceased persons, his evidence found to be reliable after close scrutiny of their evidence reveal that they have not denied incident – Both Courts below rightly convicted accused.
